Actress Katherine Heigl is suing Walgreen Co. subsidiary Duane Reade Inc. over a tweet. The actress is seeking $6 million from the company for using her name and photo to promote their brand.
Duane Reade posted a tweet with a photo of Heigl carrying a Duane Reade shopping bag while in New York City.
The company posted the image on its social media channels with the caption, “Love a quick #DuaneReade run? Even @KatieHeigl can’t resist shopping #NYC’s favorite drugstore.”
Heigl’s camp is arguing the tweet is a misusing her name and likeness. Her lawsuit also claims the company is guilty of false advertising.
Sources have said Heigl tried to resolve the matter with Duane Reade Inc. out of court. Attorneys for the actress apparently called the company after the tweet was posted, requesting it be taken down.
An attorney for the actress has noted that all proceeds from the lawsuit will be given to a charity, Jason Debus Heigl Foundation. Heigl started the charity for shelter animals in memorial to her late brother. Heigl’s brother died tragically in a car accident as a teenager. The actress started the charity in 2008.
