We win cases for our clients by being the best-prepared attorneys in the room. There is simply no substitute for preparation.
We thoroughly and meticulously conduct the discovery necessary to obtain a comprehensive understanding of our clients’ marital estates. We work with appraisers, accountants and other financial professionals who are recognized as experts in their fields to assist us in valuing our clients’ marital assets. We are relentless in uncovering any hidden assets that we think a client’s spouse may be secreting away.
Differentiating between that which is community and that which is separate property is a critical part of our discovery process. We review complex financial documents, including pensions and retirement accounts, investment assets, stock portfolios and trusts. Here in the Bay Area, with our high-tech industry, stock options have become a significant part of the community estate. The division of these options is often contentious. We are well-versed in the valuation and division of stock options and RSUs. Other assets for consideration include family-owned businesses, professional practices, investments, high-value homes and multiple real properties.
Division of community property is not just about assets; it is also about debt—IRS tax debt and credit card debt. Something that we’re seeing now is a lot of couples who wanted to get a divorce during the recession, but with one or both parties out of work, it was not financially feasible. In an improving economy, those couples may be working again and revisiting divorce, and we’re finding that they’ve often accumulated a significant amount of credit card debt that they both now share.
